This SMS Policy describes the Now Your Health SMS messaging program operated by Now Your Health, doing business as "Now Your Health." This Policy is part of, and incorporated by reference into, our Privacy Policy and Terms of Service.


1. Program Description

Now Your Health, operates an A2P 10DLC and toll-free SMS messaging program. Messages may include:

We do not send marketing or promotional text messages unless you have provided prior express written consent as required by the Telephone Consumer Protection Act, 47 U.S.C. § 227, and Federal Communications Commission implementing regulations.

2.1 How Consent Is Captured

Opt-in is always express, affirmative, and separately indicated — pre-checked boxes are never used. You may opt in via:

  1. Web opt-in form (primary method). When you enter your mobile phone number on the newsletter or lead-capture form on our Site and check the SMS consent box, this exact disclosure is shown at the point of collection:

  1. Keyword opt-in. Text the keyword JOIN to our designated SMS number. You will receive a confirmation message describing the program before enrollment is finalized.

  1. At checkout. If you voluntarily provide your mobile number at checkout and check the explicit, separate SMS consent box, you may be enrolled. Consent is not required to complete a purchase.

For every opt-in, we record and retain (in compliance with TCPA recordkeeping practice): the exact consent text shown to you, the timestamp of consent, your IP address, and the user agent string of your browser.

2.2 Consent Is Not a Condition of Purchase

Consent to receive SMS messages is not a condition of any purchase, account creation, or other transaction with Now Your Health or Now Your Health. You may shop, subscribe to our newsletter via email only, and create a member account without opting in to SMS.

2.3 Eligibility

You must be at least 18 years of age and the authorized user of the mobile number provided.


3. Message Frequency

Message frequency varies based on your activity and the time of year. Subscribers can expect up to 8 SMS messages per month under normal operation. During promotional periods (e.g., seasonal events), frequency may temporarily increase to no more than 12 messages per month. We will not exceed these limits without first providing notice and obtaining renewed consent.


4. Message and Data Rates

Message and data rates may apply. Standard SMS, MMS, and data rates charged by your wireless carrier apply to messages you send and receive as part of this program. Now Your Health does not charge any additional fee for SMS participation. Contact your wireless carrier for details about your plan's messaging rates.


5. STOP — How to Opt Out

To stop receiving SMS messages from Now Your Health at any time, reply STOP to any message we send you. Other accepted opt-out keywords include: STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT.

Upon receipt of your opt-out message, you will receive one final confirmation text acknowledging your opt-out, and no further messages will be sent to your number from this program.

  1. Now Your Health: Members-only content is now available in your account. nowyourhealth.com/login. Reply STOP to opt out.


8. Supported Carriers and Delivery

Our SMS program is supported on all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, US Cellular, Boost, Cricket, MetroPCS, and others. Carriers are not liable for delayed or undelivered messages. Now Your Health is not responsible for delays, failures, or non-delivery of messages caused by carrier outages, technical issues, handset configuration, or any cause outside our reasonable control.


9. Use and Sharing of Your Mobile Number

Your mobile phone number is used solely for the SMS program you opted into and for related transactional communications. We do not sell, rent, share, or otherwise disclose your mobile number to third parties or to our affiliates for their own marketing or advertising purposes.

We may share your mobile number with third-party service providers (e.g., our SMS aggregator and subprocessors) strictly to deliver the messages you have consented to receive. Those subprocessors are contractually restricted from using your mobile number for any other purpose.


10. Privacy and Consent Records

Your mobile phone number and your SMS opt-in record — including the consent text shown at opt-in, the opt-in timestamp, your IP address, and the user agent string of your browser — are stored securely. We retain these records for the duration of your subscription plus four (4) years following opt-out, in line with TCPA recordkeeping practice. For full details, see our Privacy Policy.

This program is operated in compliance with applicable state telephone-solicitation statutes, including:
