These Terms of Service ("Terms") govern your access to and use of the website operated by JLL Marketing, an California limited liability company doing business as "Now Your Health" ("Now Your Health," "JLL Marketing," "we," "our," or "us"), at nowyourhealth.com (the "Site"), and our newsletter, SMS messaging program, member portal, and online shop (collectively, the "Services").
By accessing or using the Services, you agree to be bound by these Terms. IMPORTANT: Section 13 contains a mandatory binding-arbitration clause and a class-action waiver that affect your legal rights. Please read carefully. If you do not agree to these Terms, do not use the Services.
You must be at least 18 years of age to use the Services or make any purchase. By using the Services, you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding agreement. If you are using the Services on behalf of an entity, you represent that you have authority to bind that entity to these Terms.

Membership is invitation-only. There is no public registration. Inquiries about membership may be directed to [email protected].
Product descriptions, pricing, and availability are subject to change without notice. We make reasonable efforts to display products accurately but do not warrant that descriptions, images, or pricing are error-free.
Placing an order does not constitute a binding contract until we accept and confirm the order. We reserve the right to refuse, cancel, or limit any order at our sole discretion, including for suspected fraud, pricing errors, or other reasons.
All transactions are processed through a PCI-compliant third-party payment processor; we do not store raw card numbers on our servers.
As part of our risk-management and fraud-prevention measures, first-time transactions on the Site may be declined by our fraud-prevention layer even when the card is otherwise valid for use at other merchants. This is a standard, industry-accepted practice to reduce chargeback risk for new accounts. A decline at our Site does not indicate any issue with your card. If your transaction is declined, you may contact your issuing bank or reach out to our support team at [email protected] for assistance.
All content on the Services — including articles, photographs, graphics, product descriptions, brand names, and editorial copy — is owned by or licensed to JLL Marketing and protected by U.S. and international copyright, trademark, and other intellectual-property laws. You may print or download content for personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercialize any content without our prior written consent.
If you submit content to us (e.g., via the contact form), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with the Services.
By subscribing to our newsletter, you consent to receive periodic editorial and promotional emails from JLL Marketing, doing business as Now Your Health. You may unsubscribe at any time by clicking the unsubscribe link in any email. Email communications are governed by the CAN-SPAM Act, 15 U.S.C. § 7701 et seq.
By providing your mobile phone number and checking the SMS consent box on any of our forms, you provide prior express written consent under the Telephone Consumer Protection Act, 47 U.S.C. § 227, and FCC implementing regulations, to receive recurring automated marketing and informational text messages (including SMS and MMS) from Now Your Health (JLL Marketing) at the mobile number provided, including messages sent by an automatic telephone dialing system or pre-recorded voice.
By providing your mobile number, you represent that you are at least 18 years of age and the authorized user of the mobile number provided. You may withdraw SMS consent at any time using STOP or by emailing [email protected].

We are not responsible for any health decisions you make based on content published on the Services.
THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BROKEN BRIDGE LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you in full.
You agree to indemnify, defend, and hold harmless JLL Marketing and its members, managers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your provision of a phone number or email address you were not authorized to use.
We reserve the right to terminate or suspend your access to the Services at any time, with or without cause, and without prior notice. All provisions of these Terms that by their nature should survive termination — including IP, disclaimers, limitations of liability, indemnification, and dispute resolution — will survive.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
You and JLL Marketing agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, the SMS program, the email program, the Site, any purchase, or our communications with you ("Disputes") will be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except as provided below.
The following Disputes are NOT subject to arbitration: (a) claims that may be brought in small-claims court if they qualify; (b) claims for injunctive or equitable relief to protect intellectual-property rights; (c) any claim where applicable law expressly prohibits arbitration.
YOU AND BROKEN BRIDGE LLC AGREE THAT ANY DISPUTE WILL BE ARBITRATED ONLY ON AN INDIVIDUAL BASIS. YOU AND BROKEN BRIDGE LLC WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION, INCLUDING ANY PRIVATE-ATTORNEY-GENERAL ACTION, IN COURT OR IN ARBITRATION. Neither you nor we may serve as a class representative, class member, or otherwise participate in a class, collective, or representative proceeding.
If a court or arbitrator determines that this class-action waiver is unenforceable as to any portion of a Dispute, that portion will be severed and proceed in court, but the remainder of these arbitration provisions will remain in full effect.
YOU AND BROKEN BRIDGE LLC EACH WAIVE ANY RIGHT TO A JURY TRIAL in any action arising out of or related to these Terms or the Services.
Arbitration will be conducted in Maricopa County, California, or, at your election, in your county of residence or by telephone or videoconference. The arbitrator's award is final and binding and may be entered as a judgment in any court of competent jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of this Section 13.
You may opt out of this arbitration agreement by sending written notice to JLL Marketing at the address in Section 17 within 30 days of first accepting these Terms. The notice must include your name, address, email used with the Services, and a clear statement that you wish to opt out. Opting out will not affect the validity of any other provision of these Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law provisions. Subject to Section 13, any judicial proceeding arising out of these Terms or the Services that is not subject to arbitration shall be brought exclusively in the state or federal courts located in Maricopa County, California, and you consent to the personal jurisdiction of those courts.
We may modify these Terms at any time. Material changes will be communicated by updating the "Last Updated" date and, where appropriate, by email or SMS notice (to subscribers who have opted in). Your continued use of the Services after the effective date of any changes constitutes acceptance of the revised Terms.
